Is this situation considered slander.? Customer making derogatory to business regarding an ex employee?
Customer of flooring firm has not paid balance of 1,200 dollars and was verbally abusive and demanding during installation.Attempting to satisfy customer, the company will lose 200 dollars even if the 1200 is paid. Trying to evade balance, customer tells business the salesman didn't know what he was doing and made derogatory remarks. Customer was unaware salesman had been hired by a custom builder and is still friendly with the 4 owners of flooring business. Salesman works for an extremely upscale wood products, but lives in the town where he had worked. Customer lives in a large condo developement of aprox. 600 units. Are her comments considered slander? Owners of first firm told salesman of customer's comments.Salesman had hand picked personally the best of order and he made no comission due to loss and stalling. This is not to sue, but is there sufficeint cause to be able to tell customer to refrain from these remarks? Any advice is appreciated.
To answer the initial question, it would likely not meet the legal conditions of slander because, although derogatory comments may have been made, it would be difficult to prove the basis of them, or that they met the legal requirement of slanderous damage resultant. To answer the greater question, do you really think that requesting that such an unpleasant and vicious person refrain from making criticism will stop them from talking? It would almost certainly incite them to escalate their behavior, and to fuel their belief that they were justified all along.
